This Privacy Policy establishes the agreement between the Service Provider, LogicFocus, and the User, governing the User's use of the Service Provider's Products and Services.

This Privacy Policy serves as a legal agreement between the User, who is using the platform, and the Service Provider, who provides the Product. The User must be a natural person who is at least 18 years old.

1. Introduction and Applicability of the Privacy Policy:

1.1. The Service Provider is strongly committed to respecting the User's online privacy and recognizes the importance of protecting and managing any personal information collected by us.

1.2. The purpose of this Privacy Policy is to establish a framework for the collection, use, and protection of personal and sensitive data obtained by the Service Provider through the Platform. This Policy outlines our procedures for collecting, using, processing, disclosing, and protecting information obtained by the Service Provider.

2. Disclaimer:

2.1. Please be aware that any information obtained by us will be:

a. processed fairly and lawfully for the provision of the Services;

b. collected only for specified and lawful purposes, and not used in any way that goes against applicable laws or policies;

c. adequate, relevant, and not excessive for the intended purpose;

d. reviewable and updatable by the User when necessary;

e. retained for no longer than necessary or as required by applicable law.

2.2. By using the Product, the User explicitly agrees to the collection, use, and transfer of data as described in this Privacy Policy, without limitation or qualification.

2.3. It is important for the User to read this privacy policy carefully as it impacts their rights and responsibilities under the law.

3. User's Consent:

3.1. By providing the Information (as described below), the User gives consent and authorizes the Service Provider to collect, use, or disclose such Information for business and research purposes as stated in this Privacy Policy and the Terms of Service. The User also understands and consents to the transfer of this Information to third-party users for the purpose of providing services through the Platform, or to third-party providers for the provision of Services, jointly developed or marketed services, payment processing, order fulfillment, customer services, data analysis, information technology services, and other services that enable the Service Provider to provide Services through the Platform.

3.2. This Privacy Policy is legally binding. By visiting or accessing the Platform and voluntarily providing the Service Provider with Information (including Personal Data), the User consents to the Service Provider's use of that Information in accordance with this Privacy Policy. If the User does not agree with this Privacy Policy, they may refuse or withdraw consent at any time or choose not to provide Personal Information to the Service Provider. However, under such circumstances, the Service Provider may be unable to provide Services.

3.3. To withdraw consent, the User can send a notification to support@facimate.net. The withdrawal will be processed in accordance with our Data Process Agreement (DPA), which is available at the provided address.

4. Types of information collected by Service Provider:

4.1. "Personal Data" refers to any information that identifies a natural person, such as their name, contact details, email address, gender, age, or other relevant information provided by the User. It also includes information about the User's caregiver, including their name, age, gender, mobile number, and relationship with the User.

4.2. "Technical Information" encompasses information gathered through technologies like cookies, web beacons, or similar methods, which automatically record certain details from the User's device when accessing the Platform. This technical information may include the User's Internet Protocol (IP) address, device or browser type, Internet service provider.

(ISP), referring or exit pages, clickstream data, and operating system. This data includes usage information and user statistics.

4.3. "Locational Information" refers to information obtained through GPS or other means that determine the User's geographical location.

4.4. "Non-Personal Information" includes information that does not reveal the User's specific identity, such as browser information, data collected through cookies, pixel tags, and similar technologies, demographic information, etc. When visiting the Platform, the Service Provider automatically collects certain information about the User's computer or mobile device to facilitate, evaluate, and verify their use of the Platform. This information may include environmental variables like browser type, operating system, CPU speed, referring or exit web pages, click patterns, and the IP address of the User's computer. This data is generally collected in an aggregated form without identifying individual users. Non-Personal Information also includes information shared with the Service Provider during the use of Services, such as chats with Service Provider representatives.

(All the above-mentioned types of information collectively referred to as "Information.")

5. Purpose of Collecting and Using this Information:

5.1. The data collected by the Service Provider is used to maximize the benefits the User receives from the Platform. The following is a limited list of functions for which this information is used:

a. Providing Services as defined in the Terms of Service.

b. Maintaining the Platform.

c. Evaluating the quality and competence of personnel.

d. Resolving User complaints and ensuring the provision of high-quality Services.

e. Notifying Users about changes to the Platform.

f. Enabling User participation in interactive features of the Platform.

g. Providing analysis or valuable information to improve the Platform.

h. Monitoring Platform usage.

i. Detecting, preventing, and addressing technical issues.

5.2. Business or Research Purposes: The Information, excluding Personal Data, is used for business or research purposes, including enhancing and customizing the Platform's ease of use and the products and services offered. The Service Provider may archive this information for future communications, updates, and surveys.

5.3. Aggregating Information/Anonymized data: The Service Provider may aggregate and analyze Information to improve the level of services offered to customers. This includes statistics on the average number of Platform users, service clicks, features used, response rates, and other similar data regarding groups or individuals. However, no Personal Data is disclosed in this process.

6. Disclosure and Sharing of Information:

6.1. The Service Provider does not rent, sell, disclose, or share any Information collected from the User with third parties, except when necessary to provide the User with the Services as per the Product's functionality. In such cases, the Service Provider follows legal procedures and complies with its legal obligations. The Service Provider may share the User's Information under the following circumstances and for the specified purposes:

a. Sharing information with third-party service providers/vendors to provide the User with the Services as per the Product's functionality.

b. Disclosure compelled by law:

The Service Provider may disclose any Information provided by the User on the Platform if it is deemed necessary or appropriate:

i. under applicable law, including laws outside the User's country of residence, to comply with legal processes;

ii. to respond to requests from public and government authorities, including those outside the User's country of residence;

iii. to protect the Service Provider's operations or those of its affiliates;

iv. to protect the rights, privacy, safety, or property of the Service Provider, its affiliates, the User, or others;

v. to pursue available remedies or limit potential damages;

vi. to protect against legal liability;

vii. to protect the personal safety of users of the Platform.

c. Merger or Acquisition: In the event of a merger or acquisition involving the Service Provider, the User will be notified in advance, and Information may be shared as part of the transaction.

d. Employees/Agents of the Service Provider: The Service Provider maintains a strict confidentiality policy and may disclose confidential information to its employees or other personnel only on a need-to-know basis. Any breach of confidential information by employees or personnel is dealt with strictly.

6.2. Except for the Information disclosed pursuant to sub-clauses (a), (b), (c), and (d)of Clause 6.1 above, the Service Provider may share Information if the User authorizes it to do so.

6.3. The Service Provider does not share Information with any third party other than those specified in this provision, unless the User provides prior written consent.

7. Transfer of Information

7.1. The User's information may be transferred and stored on computers located outside of the User's jurisdiction, where data protection laws may differ.

7.2. If the User chooses to provide information, it may be transferred outside the User's jurisdiction for processing. If further clarification is needed regarding data transfer, the User can contact the Service Provider.

7.3. By consenting to this Privacy Policy and submitting information, the User agrees to the transfer of data as described.

7.4. The Service Provider will take reasonable steps to ensure that User data is treated securely and in accordance with this Privacy Policy. No transfer of User data will occur to an organization or country without adequate controls in place to ensure data security.

8. User's Rights

The User has various rights regarding their Personal Data under applicable law. These rights may include:

a. Accessing, confirming, and reviewing provided Personal Data;

b. Correcting inaccurate or irrelevant Personal Data;

c. Deleting and erasing Personal Data from publicly available pages of the Platform;

d. Receiving Personal Data held by the Service Provider in a portable format;

e. Objecting to or restricting certain forms of processing.

To exercise these rights, the User can contact the Service Provider at the email address provided in Clause 3.3 above.

9. Third-Party Services

We might engage the services of third-party companies and individuals for the following purposes:

- Streamlining the functioning of our Service.

- Offering the Service on our behalf.

- Executing services linked to our Service.

- Aiding us in examining the usage patterns of our Service.

When using third-party mobile applications that are not operated by us, the User is advised to review the privacy policy of each application. The Service Provider does not have control over and is not responsible for the content, privacy policies, or practices of any third-party mobile applications or servicesThe Service Provider is not responsible for any disclosure of information by the User or unauthorized access by third parties, and the User agrees not to hold the Service Provider liable unless such breach is a direct result of the Service Provider's negligence or willful default.

10. Children's Privacy

Our Services are not intended for individuals under the age of 13. We do not knowingly gather personally identifiable information from children below the age of 13. In the event that we become aware that a child under 13 has shared personal information with us, we promptly remove this data from our servers. If you are a parent or guardian and are aware that your child has shared personal information with us, kindly get in touch with us so that we can take appropriate actions.

11. Retention of Information

Except for cases of withdrawal or termination, the Information provided by the User will be stored in locations outside the direct control of the Service Provider, such as servers or databases co-located with hosting providers. However, the Service Provider may retain a portion of the Information for periods required by applicable law. Even after the deletion of an account, data may be retained for reasons such as unresolved account issues, claims, or disputes; legal requirements; or legitimate business interests such as fraud prevention and enhancing user safety and security, in aggregated or anonymized form.

12. Cookies and other Tracking Technologies

12.1. The Platform may use "cookies" and other Technical Information to collect data on Platform activity. These cookies do not grant access to the User's computer or mobile device. Users can choose to deny the installation of cookies through their web browser settings, although this may limit the full functionality of the Platform.

12.2. The use of cookies and Technical Information allows the Service Provider to improve the Platform and enhance the User's experience. Technical Information that does not contain Personal Data may also be analyzed for trends and statistics.

Enabling analytics cookies will improve the User's website experience and enhance the Service Provider's service offerings.

13.Log Data

Whenever you utilize our Service and encounter an error within the app, we gather data and details (via third-party tools) from your device. This data, known as Log Data, might encompass information like your device's Internet Protocol (“IP”) address, device identifier, operating system version, app configuration settings during your use of our Service, timestamps of your interactions with the Service, and various statistical information.

Within this Service, you may encounter links leading to other websites. Clicking on a link to a third-party website will redirect you to that specific site. It's important to note that these external websites are not under our operational control. Hence, we strongly recommend that you take the time to read and understand the Privacy Policy of these linked websites. We lack authority over and disclaim responsibility for the content, privacy policies, or operational methods of any third-party websites or services.

16. Changes and updates to Policy

The Service Provider may modify or revise the Privacy Policy and will notify Users of any changes by posting the revised Privacy Policy on the Platform. Users are advised to periodically review the Privacy Policy to stay informed of any updates. Continued use of the Platform and Services after an update implies acceptance of the revised privacy policy.

18. Miscellaneous

The invalidity or unenforceability of any part of this Privacy Policy does not affect the validity or enforceability of the remaining provisions. This Privacy Policy does not apply to information other than that collected by the Service Provider through the Platform. Unsolicited information provided by Users through the Platform or other means is considered non-confidential and may be used or disclosed by the Service Provider without limitations. The rights and remedies under this Policy are cumulative and not exclusive, and any waiver must be in writing. Delay or non-exercise of any right or remedy does not constitute a waiver.
